| This course provides students with an opportunity to study the substantive patent law issues which constitute conditions for patentability. Specifically, this course explores the case law which has evolved in connection with the interpretation of several key statutory sections of Title 35 (the 1952 Patent Act), including § 101 (eligible subject matter and utility), § 102 (prior art, novelty, and loss of right), § 103 (non-obviousness), and § 112 (disclosure). Additional topics include: infringement, claim interpretation, patent misuse/antitrust law and a broader analysis of the social trade-off underlying this unique form of intellectual property protection.
