| This seminar will examine the problems in achieving accountability of multinational corporations for their conduct overseas. It will be a writing seminar providing students with supervised research and writing experience. Students will have periodic individual meetings with the instructor, but the seminar as a group will not meet regularly. Topics for this seminar will include such substantive areas as the problems encountered in responding to: (1) alleged violations of human rights involving forced labor, unsafe working conditions, and environmental abuse, (2) the extraterritorial enforcement of American Trade sanctions for nation security or foreign policy considerations, include the Cuban, Iraqi and Iranian embargoes of today and the China and Soviet Union embargoes of yesterday, (3) the Foreign Corrupt Practices Acot and international conventions dealing with corporate bribery of foreign officials; (4) the Arab Boycott Act, and (5) International Guidelines (OCED, International Chamber of Commerce), codes of conduct, and industry standards. Topics may also include study of national and international jurisdiction and procedure doctrines creating obstacles for the litigation of overseas matter in United States courts, particularly matters arising under the Alien Tort Claims Act and the enforcement of foreign judgments. | |||||||
